Terms and Conditions
This English version is provided for convenience. Only the German version of these Terms and Conditions is legally binding.
As of: October 2026
§ 1 Scope, consumers and businesses
(1) All services and offers of Dr. Christopher Schwake (hereinafter “Contractor”), in particular coaching, workshops, trainings, courses and events, are provided on the basis of these General Terms and Conditions. They form part of all contracts that the Contractor concludes for his services. The respective contracting party is hereinafter referred to as “Client”; this also includes companies that place an order.
(2) These terms apply to consumers and businesses. A consumer is any natural person who concludes a contract for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (Section 13 BGB). A business is any natural or legal person or partnership with legal capacity that, when concluding the contract, acts in the exercise of its commercial or independent professional activity (Section 14 BGB). Provisions marked “Businesses only” do not apply to consumers.
(3) Businesses only: These terms also apply to all future services, even if they are not separately agreed again. Terms and conditions of the Client or third parties do not apply, even if the Contractor does not separately object to their validity in an individual case.
§ 2 Conclusion of contract, content of contract, appointments, right of withdrawal
(1) A contract is concluded when the Contractor accepts an order in text form (for example by email) or when both parties sign a written agreement. An electronic signature, for example via Zoho Sign, is sufficient. An acknowledgment of receipt by email does not yet constitute acceptance.
(2) Booking a free initial call via the online booking system does not create any payment obligation or any contract for coaching.
(3) An offer by the Contractor is valid for 14 days from receipt.
(4) The contracts are service contracts unless expressly agreed otherwise. What is owed is the provision of the agreed service, not a specific result, in particular not a specific economic result. Statements and recommendations by the Contractor prepare the Client’s own decisions and do not replace them.
(5) Coaching is not psychotherapy and not the practice of medicine. The Contractor does not make diagnoses and does not treat illnesses. Coaching does not replace medical or psychotherapeutic treatment. The Contractor makes no promises of healing.
(6) Coaching appointments are agreed by mutual consent. Coaching takes place in the Contractor’s premises in Potsdam or by video. The Contractor determines the date and place of events.
(7) For online appointments and online events, the Client receives the access details before the appointment. A password must be treated confidentially and must not be passed on to third parties. The Client is responsible for suitable technical equipment and an undisturbed place protected from being overseen by third parties. The Contractor is not liable for disruptions outside his sphere of influence, for example at internet providers or on the Client’s side. Liability under § 6(2) remains unaffected.
(8) If the Client is a consumer (Section 13 BGB) and the contract was concluded at a distance (for example by email, phone, video or electronic signature) or outside the Contractor’s business premises, there is a statutory right of withdrawal. The following withdrawal notice provides information about it.
Withdrawal notice
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us (Dr. Christopher Schwake, Gutenbergstr. 65, 14467 Potsdam, Germany, phone +49 331 96795086, email contact@drchristopherschwake.com) of your decision to withdraw from this contract by means of a clear statement (for example a letter sent by post or an email). You may use the attached model withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and at the latest within fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you; in any event, you will not incur any fees as a result of such reimbursement.
If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
Model withdrawal form
(Complete and return this form only if you wish to withdraw from the contract.)
To Dr. Christopher Schwake, Gutenbergstr. 65, 14467 Potsdam, Germany, email contact@drchristopherschwake.com:
I/We (*) hereby give notice that I/we (*) withdraw from my/our (*) contract for the provision of the following service (*): ______
Ordered on (*) / received on (*): ______ · Name of consumer(s): ______ · Address of consumer(s): ______ · Signature of consumer(s) (only if this form is notified on paper): ______ · Date: ______
(*) Delete as appropriate.
End of withdrawal notice
(9) Early start of services: If coaching with consumers is to begin before the withdrawal period has expired, the Client expressly declares this in text form, usually with the coaching agreement. In the event of a later withdrawal, compensation must be paid for the sessions provided up to that point in proportion to the total scope, in accordance with Section 357a(2) BGB. The right of withdrawal expires when the service has been provided in full and the Client expressly agreed before the start and confirmed being aware that the right of withdrawal expires upon complete performance of the contract (Section 356(4) BGB).
§ 3 Fees, terms of payment
(1) Fees are charged in euros. Prices for consumers are final prices including statutory VAT. Businesses only: prices are exclusive of statutory VAT.
(2) Coaching packages are invoiced upon conclusion of the contract and are due for payment before the first session. Payment in installments may be agreed on request; the agreed installments fall due on the stated dates.
(3) Other services, in particular trainings and workshops, are due for payment without deduction within 14 days of receipt of the invoice, unless otherwise agreed. The invoice states the due date.
(4) Fees for online courses are payable in advance by PayPal or credit card. An invoice is issued in this case as well.
(5) The statutory provisions apply to default in payment.
§ 4 Cooperation, disruptions
(1) The Client provides the Contractor in good time with the information required for the service. Ongoing medical or psychotherapeutic treatment, or health restrictions that may be relevant for body-oriented or meditative exercises, are disclosed before the start. Details do not need to be disclosed.
(2) The Client behaves during the provision of services, in particular in group events, in such a way that no one is endangered and the process is not disrupted.
(3) The Client refrains from making untrue factual claims and abusive criticism about the Contractor on the internet.
§ 5 Cancellation and rescheduling of appointments, cancellation of bookings, termination
(1) Coaching appointments can be cancelled or rescheduled free of charge up to seven (7) working days before the appointment. This period makes it possible to offer the slot to someone else. In the event of later cancellation or non-attendance, the appointment is deemed to have been used; for individually agreed appointments, the fee is charged. The Client is entitled to prove that the Contractor has suffered no loss or a significantly lower loss. If the slot can be given to someone else, this will be credited. In justified cases, for example illness, the Contractor may agree to short-notice rescheduling.
(2) Booked events can be cancelled up to four (4) weeks before the start; in this case 50% of the event fee is charged as a cancellation fee. In the event of later cancellation or non-attendance, the full fee is due. The Client is entitled to prove that the Contractor has suffered no loss or a significantly lower loss.
(3) The Contractor may cancel individual appointments for good cause, in particular in the event of his own illness or force majeure; a replacement appointment will be offered promptly. The Contractor may terminate the collaboration for good cause, in particular if it becomes apparent that medical or psychotherapeutic treatment is indicated, if the basis of trust is permanently disturbed, or if a case under paragraph 5 applies. In these cases, only the services provided are charged; amounts already paid for sessions not provided are refunded pro rata. Further claims are governed by § 6.
(4) If an event has to be cancelled, for example because the minimum number of participants is not reached, the Contractor informs the registered persons as early as possible and refunds the fee already paid. Further claims are governed by § 6.
(5) If a Client continues to disrupt events contrary to § 4(2) despite a warning, the Contractor may withdraw from the contract if continuation has become unreasonable for him. Payments for services not provided are refunded.
§ 6 Liability, force majeure
(1) Participation in coaching and events requires a normal level of psychological and physical resilience. All exercises are voluntary. All participants pay attention to their own limits and can end any exercise at any time.
(2) In the event of intent and gross negligence on the part of the Contractor, his representatives or vicarious agents, and in the event of culpable injury to life, body or health, the Contractor is liable in accordance with the statutory provisions.
(3) In the event of simple negligence, the Contractor is liable for property damage and financial loss only in the event of a breach of an essential contractual obligation, limited in amount to the damage foreseeable and typical for the contract at the time of conclusion. Essential contractual obligations are those whose fulfillment characterizes the contract and on whose observance the Client may rely. This limitation does not apply in the cases of paragraph 2, to guaranteed characteristics or to liability under the German Product Liability Act.
(4) If the Contractor cannot provide a service due to force majeure, for example strikes, severe weather, official orders or comparable events beyond either party’s control, a replacement appointment will be agreed. If a replacement appointment is not possible or not reasonable for the Client, amounts already paid for services not provided are refunded.
§ 7 Confidentiality
(1) The Contractor treats all content from coaching and all professional, business and private matters of the Client that become known to him in the course of the collaboration confidentially, also after the end of the contract.
(2) The Client maintains confidentiality about the professional, business and private matters of other participants that become known in group events, also after the end of the contract.
(3) Confidentiality does not apply insofar as there is a legal obligation to disclose or disclosure is necessary to avert a serious danger to the life or health of the Client or other people.
(4) If coaching is commissioned by a company for a person working there, the company receives, without the express consent of this person, only information on appointments and scope, no content. Details are governed by the respective agreement.
(5) Both parties ensure that their assistants and vicarious agents also comply with these obligations.
§ 8 Intellectual property, recordings, references
(1) The Contractor’s content, concepts and working materials are protected by copyright. The Client may use them for their own purposes within the scope of the respective assignment. Any further use, in particular commercial use, requires the Contractor’s prior consent.
(2) Audio and video recordings of coaching or events are only made with the prior consent of the persons recorded. Use for advertising purposes only takes place with separate, express consent in text form. Consent may be withdrawn at any time with effect for the future.
(3) The Contractor names clients or commissioning companies as references only with express consent in text form.
§ 9 Access to online portals
(1) Access to the Contractor’s online portals (for example a digital library with audio and video recordings, texts and other files) is personal and non-transferable. Unless otherwise agreed, it ends with the end of participation in the respective event or program. § 8(1) applies to the content.
(2) If access data or content is passed on to unauthorized persons, the Contractor may block access and terminate the contract for good cause. Further claims are reserved.
§ 10 Multi-part programs
(1) Content, duration, the share of in-person and online sessions, and materials of multi-part programs are set out in the respective offer. Recorded content is available to participants for the duration of the program, unless otherwise agreed.
(2) If in-person participation is planned for individual sessions and is not possible for good cause, the Contractor may enable participation online. § 2(7) applies accordingly.
§ 11 Consumer dispute resolution
The Contractor prefers to resolve concerns in direct conversation. He is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act.
§ 12 Place of performance, place of jurisdiction, applicable law
(1) Businesses only: the place of performance for all claims arising from the contractual relationship is Potsdam.
(2) If the Client is a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Potsdam. The Contractor is also entitled to sue at the Client’s general place of jurisdiction.
(3) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the state in which they have their habitual residence.
§ 13 Final provisions
Should individual provisions of these terms or of the contract be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the statutory provision.
